Five Red Flags of PIP Fraud in Florida Claims
Florida’s no-fault system pays up to $10,000 in personal injury protection benefits with limited friction, which is exactly why organized PIP fraud has been a Florida industry for decades. Most fraudulent PIP files aren’t invisible. They telegraph. These are the five patterns we’re asked to document most often.
1. The crash that doesn’t match the cars
Low-speed contact, minor property damage, and four occupants all claiming similar soft-tissue injuries within days. Staged and caused collisions are choreographed for the claim, not the physics. Scene facts, vehicle damage documentation, and participant histories usually tell the real story.
2. Templated treatment
Identical treatment schedules across unrelated claimants: same clinic, same modality mix, same duration, bills clustering just under the PIP limit. That’s not medicine; it’s a billing script. The clinic’s pattern across claims matters more than any single file.
3. The recurring cast
Same passengers, same tow operator, same referring “friend,” same attorney of record across multiple losses. Claims are staged by networks, and networks repeat. Prior-claims history and link analysis surface the cluster.
4. The 14-day sprint
Florida’s PIP statute requires initial treatment within 14 days, and fraudulent claims treat that deadline as a starting gun: filing, clinic intake, and attorney representation all inside the first week, often before the police report is available. Legitimate injuries rarely move with that much administrative discipline.
5. Limitations that don’t survive a Tuesday
The claimed disability is the easiest element to test. A claimant who “can’t sit for more than twenty minutes” but drives ride-share afternoons, or “can’t lift” but works a cash job unloading trucks, has created a record that will decide the claim, if someone documents it lawfully and in time.
