What Makes Surveillance Evidence Hold Up in Court

Any investigator can hand you video. Whether that video survives a motion to exclude, a chain-of-custody challenge, and a cross-examination is a different question, decided long before trial, by how the surveillance was conducted and documented on the day it happened.

Lawful acquisition, or nothing

Surveillance in Florida is legal from public vantage points, without trespass, without audio interception, and without pretext that crosses statutory lines. Footage obtained outside those boundaries isn’t aggressive investigation; it’s a suppression motion waiting to happen, and it can poison the rest of the file. Every APB operation is scoped against Chapter 493 and reviewed for acquisition risk before anyone deploys.

The log is the evidence behind the evidence

Opposing counsel rarely attacks the video first. They attack the record around it: When did you arrive? How do you know it was the claimant? What happened during the gap between clips? An investigator with a contemporaneous log (time-stamped, GPS-referenced, entry by entry from arrival to departure) answers from the record. An investigator without one improvises under oath. Juries can tell the difference.

Chain of custody is a discipline, not a form

Original media preserved, hashes recorded, every transfer documented, working copies segregated from originals. It takes minutes when it’s habit and it’s unrecoverable when it’s not. If the defense can’t establish that the video in the courtroom is the video from the field, nothing else about it matters.

The investigator is part of the exhibit

Video doesn’t testify; the investigator does. That means disciplined reports with no editorializing, no conclusions the footage doesn’t support, and a witness who has been deposed before and knows how to hold a record.
